In short

We prepare your Modelo 210 and your Spanish gestor files it. You give us correct information on time and approve the draft. If a mistake on our side costs you a Spanish surcharge, we pay it back.

What we do

ModeloTax prepares your yearly Spanish non-resident tax return, the Modelo 210. We read your documents, make a draft and connect you with a Spanish gestor. Your gestor checks the draft and files it with the Spanish tax office.

Figures you see before your gestor has checked them are an estimate. They are information, not tax advice.

What we ask of you

  • Give us correct and complete information.
  • Upload your documents by the date we give you.
  • Check the draft and approve it before your gestor files it.
  • Tell us when something changes, for example when you sell the property or move to Spain.

Your gestor

Your gestor is an independent Spanish tax adviser who works with us. To file for you, they need your authorization, which you sign in the app. You can withdraw it at any time by emailing us.

We stay your contact for everything. If something goes wrong, you come to us and we sort it out with your gestor.

Price and payment

You see the price before you pay. You pay our service fee on our secure payment page.

Your Spanish tax is separate. The Spanish tax office collects it, usually by direct debit. That tax is always yours to pay.

You buy each year's filing yourself, on our payment page. Nothing renews and nothing is charged automatically.

Your right to cancel

You can cancel within 14 days of signing up, without giving a reason. If you ask us to start straight away, this right ends once your return has been filed. If you cancel after we started but before filing, we refund what you paid minus a fair share for the work already done.

To cancel, email hello@modelotax.com. You can use this text, but you do not have to: "To ModeloTax B.V., Dorpsdijk 27, 3161 KC Rhoon, the Netherlands, hello@modelotax.com. I hereby withdraw from my contract for the ModeloTax service. Signed up on: [date]. Name: [name]. Address: [address]. Date: [date]."

If something goes wrong

If the Spanish tax office charges you a surcharge or interest because of a mistake by us or your gestor, we pay it back, up to the amount you paid us for that filing.

We do not pay it back when it comes from information that was wrong, incomplete or late on your side. The same goes for a risk we told you about beforehand and you accepted, such as filing close to the deadline.

These limits do not apply if we cause damage on purpose or through gross negligence.

Stopping

You can stop at any time by emailing us. We may end the service if you break these terms, for example by giving false information. We tell you first. What happens to your data is on our privacy page.

Complaints

Not happy with something? Email hello@modelotax.com. We look into it and reply in writing. If we cannot solve it together, you can go to court. As a consumer you can always go to the court where you live.

Law and language

Dutch law applies to these terms. If you live elsewhere in the EU, you keep the protection your own country's consumer law gives you. The English version of these terms is the original.

Changes

If we change these terms, we email you at least 30 days before. If you do not agree, you can stop before the change takes effect.
