In short

We use your details to prepare your Modelo 210 and to have your gestor file it. We store your data in the EU and we never sell it. You can always ask to see it or have it deleted.

Who we are

ModeloTax B.V. in the Netherlands is responsible for your data on this website and in the app. You find our company details in the imprint. Questions about your data? Email hello@modelotax.com.

Your gestor is the Spanish tax adviser who files your return. They are responsible for their own part of the work. They file under their own name and keep their own records, as Spanish law requires.

What we collect

  • Your account: name, email address, phone number and language.
  • Personal and tax details, such as your date of birth, address, NIE and country of tax residence.
  • Your property: its address, cadastral reference and your share in it.
  • The documents you upload, such as your purchase deed, IBI receipt, rental statements and passport.
  • Payments: what you paid us and, for direct debit, your IBAN.
  • Your signature on the authorization that lets your gestor file for you.
  • Messages between you, us and your gestor.
  • If you contact us or ask to become a partner: your name, email address, phone number, company and message. We keep these while we are in touch about it.
  • If the other owner of your property adds you, we get your name, NIE and country of tax residence from them.
  • Technical data, such as when you signed in, and the time, language and internet address when you accept our terms or sign your authorization. We use it to keep your account safe and as proof.

What we use it for

We read your documents automatically, so you do not have to type everything. Your gestor checks the result and you approve every filing before it goes to the Spanish tax office. No decision about you is made by software alone.

  • To prepare and file your return. That is the service you ask us for, and we cannot do it without this data.
  • To charge our service fee and keep our accounts, as Dutch law requires.
  • To keep the service secure, to prove what you agreed to and signed, and to keep a record of who looked at your data. That is our legitimate interest, and it protects you too.
  • To send you emails about deadlines, your filing and payments. These are part of the service.
  • To fill in your IBAN for the Spanish tax payment or refund. Only if you say yes for that filing.
  • To measure our website and our ads. Only if you accept cookies.

Who we share it with

We never sell your data.

  • Your gestor, so they can check and file your return.
  • The Spanish tax office (Agencia Tributaria), when your gestor files.
  • Spanish public registers, to look up your property: the land registry (Catastro) and the national address service (CartoCiudad).
  • Companies that run parts of our service for us, such as hosting, email, payments and electronic signatures. See the list on our sub-processors page.

Where your data is

We store and process your data in the EU. Some of our providers have a parent company in the United States. Their contracts with us include the EU's standard contract clauses, or they are certified under the EU-US Data Privacy Framework. Email us if you want to see them.

How long we keep it

We keep your documents and filings for as long as you have an account. If you want your account closed, email us and we delete your data. Some records we must keep longer:

  • Invoices and payment records: 7 years, as Dutch tax law requires.
  • The authorization you signed: while it is valid and 6 years after.
  • A record of who looked at your data: 7 years. It holds only facts, never the content of your documents.
  • Backups: deleted data stays in our encrypted backups for a limited time, then it is gone.

Your rights

You can ask us to see your data, correct it, delete it or limit what we do with it. You can also ask for a copy to take elsewhere, or object to how we use it. Email hello@modelotax.com. We answer within one month.

Did you give consent for something? You can withdraw it at any time.

Not happy with how we handle your data? Tell us first. You can also complain to the Dutch data protection authority (Autoriteit Persoonsgegevens) or the authority in your own country.

Changes

If we change this page in a way that matters to you, we let you know by email before the change takes effect.
