Missed Modelo 210 years: how to catch up
Last checked on
In short
File the missed years yourself, before the Spanish tax office finds them. A late but voluntary filing costs a surcharge of 1% plus 1% for each full month late, and 15% plus interest after 12 months. If the tax office contacts you first, you usually pay a penalty of 50% or more.
How far back can the Spanish tax office go?
Four years. The four years start when the filing window ends, not when the tax year ends.
For own use, the window closes at the end of the following year. So a tax year stays open for about five years after it ends.
Example: own use for tax year 2021 had to be filed by 31 December 2022. The four years run from then, so 2021 stays open until around the end of 2026.
Older years are normally time-barred (prescripción).
What does a late Modelo 210 cost?
If you file before the tax office contacts you, you pay a surcharge (recargo). There is no penalty.
The surcharge drops by 25% if you pay the tax when you file. You must also pay the surcharge on time once it is billed.
Example: €250.80 tax, filed 30 months late. The surcharge is 15%, so €37.62, plus interest for the months after the first year.
| When you file | What you pay on top | Interest |
|---|---|---|
| Up to 12 months late | 1% plus 1% for each full month late | None |
| More than 12 months late | 15% surcharge | Yes, from month 13 |
| Late, with nothing to pay | A fixed penalty of €100 | None |
What if the tax office finds it first?
Then it is no longer voluntary. You pay the tax, interest and a penalty (sanción).
- The penalty usually starts at 50% of the unpaid tax.
- It can be higher in serious cases.
- Once a formal letter (requerimiento) arrives, the lower surcharge no longer applies.
- Filing yourself first avoids the penalty.
How do you catch up on missed years calmly?
One year at a time. Each year is its own filing, with its own rules and rates.
- List the years you missed, per home and per owner.
- Start with the oldest open year. Later years can depend on earlier ones, for example rental costs carried forward.
- Gather the documents for each year: the IBI receipt for that year, rental statements and invoices.
- File each year and pay the tax in full when you file.
- With ModeloTax you add earlier years and upload the documents for each one. We help you prepare each filing and a gestor checks it.
What if I filed but made a mistake?
That can be fixed for any open year.
- You paid too little: you make a supplementary filing (complementaria). The original stays in place.
- You paid too much: you ask for a correction (rectificación). The Spanish tax office decides on it.
- A correction can affect the following years, for example when costs were carried forward.
Questions about this
- Will I get a fine for a forgotten Modelo 210?
- Not if you file before the Spanish tax office contacts you. You pay a surcharge instead, which is lower than a penalty.
- Should I wait and see if Spain notices?
- No. The surcharge grows with time and you risk a penalty. Filing yourself is almost always cheaper.
- Do I need the documents from those years?
- Yes, per year. For own use, the cadastral value of that year matters most. The IBI receipt for that year shows it.
- Do old years use the new deadlines?
- No. Each year keeps its own deadline. The surcharge is counted from that deadline.
- Does an old year use the rates of that year?
- Yes. Each year uses its own rules, rates and cadastral value, even when you file it years later.
